Tracks ARE licenced, but rTractor modders don't bother, on the assumption that because it's a not-for-profit personal venture then it's okay. In actual fact they should also apply for a licence, legally speaking.

However, the chances of a track company coming after a modder is slim, whereas lawsuits are much easier against registered companies...
