Well even if the person is not going to jail, only way to get rid of the source of the problem (ie speeding, running from police, street racing, etc), is to get rid of the car!!
What is so bad about it anyways... I know they are taking away your property, but it isn't the
only piece of property that can be taken from you if you break the law, because it is the source of all the problems -- along with the owner.
Example:
Own a handgun? Illegal in most states, so they take it from the dude to prevent any further danger.
Own lots of cocaine? Well obviously it will be taken from you. Can't let them keep that kind of property
.
It really is no different from any other form of breaking the law, including being dangerous in a vehicle, which could injure or hurt someone. But this isn't just for a simple speeding ticket or stop light violation, it is definitely for something
very illegal and/or the owner's refusal to obey the law.
