Legally speaking a EULA in the UK is invalid if it is presented after money changes hands, hense the LFS EULA being displayed before purchase. Microsoft's EULA doesnt even muster a candle in the wind under UK law. Nor does any computer software product where the EULA is not displayed on the outside of the packaging.
Further a consumer has the right to reffer to the original EULA if the company changes the EULA at a later date and forces an "I Agree". This is because a EULA is a contract, and is protected by the same laws as any other contract.
No contract, aside from the sale of goods act, is implied when purchasing software in the UK unless specifically stated prior to purchase, software is considered a product not a service.
In America I am not aware of consumers having this legal protection, W4H's is American if I recall rightly. So he isn't pwned, he's just different that's all ;P
As for the modding thing, it's well documented that the devs dont want to see it on these forums. I'm not aware of them saying you cannot do it. It might be in the forum T&C's
